The Review Team

Why an independent review team?

The CMCA Review process's Guidling Principles were established so that all parties to the CMCAs (primarily OTML, the communities and the PNG Government) would be confident that the process was robust and the new agreements reached would stand the test of time.

For this reason, the parties and organisations and individual outside of the negotiations also need to be confident that the process is fair to all parties, and manifestly allows for people to be heard and influence the outcomes of the review appropriately,

As OTML is both a major party to the agreements, and the provider of logistical and funding to the process, it was decided with the agreement of the communities that devises should be used to make the mechanics of the process "at arms' length" from OTML.

This meant that OTML has engaged Independent Facilitators to facilitate the process, Independent Observers to scrutinise the process against the Guiding Principles, and an Independent Funds Administrator to administer funds on behalf of the working group at the heart of the consultation process decision-making.


The Keystone Centre - Independent Facilitators

The independent facilitator team is led by The Keystone Centre, a US-based non-profit public policy and educational organization founded in 1975.  Keystone strives to develop creative problem-solving processes that help diverse parties to resolve complex and often contentious issues in the areas of energy, environment, and health.


Tanorama - Independent Facilitators

The PNG partner with Keystone in facilitating the review process is Tanorama Ltd. Tanorama is a PNG-based company set up in 1994 with to provide advisory, training and project management services, particularly on projects and advisory assignments funded by Government and Donors (such as AusAID, World Bank and Asian Development bank).


John Kawi and Dr Beno Boeha, Independent Observers

The independent observer team is led by Mr John Kawi, a former PNG Solicitor General. Working with him is Dr Beno Boeha, an experienced research scientist and former Director of the National Research Institute. The role of the Independent Observers is to observe and report publicly on the conduct of the review process, using the Guiding Principles as the reporting framework.


Independent Advisers

Advice to community and NGO representatives that is independent from OTML and the government is being funded through the review. Two independent advisers have been appointed to date. Sir Arnold Amet, a former Chief Justice of the PNG Supreme Court (and formerly lead Independent Observer of the review) is providing advice on legal issues and government processes, as well as general advice as required. Environmental scientist, Dr Alan Tingay, has undertaken an independent review of the research relating to environmental and health impacts of the mine as well as consulting with affected communities.


Deloitte Touche Tohmatsu - Independent Administrator

Accounting and financial advisory firm, Deloitte Touche Tohmatsu is the Independent Administrator for the review. Under an "arms length" contract with OTML, Deloitte administers a trust fund to support the review and provides a range of administrative services.
